Bit hard to tell, but the middle toe looks longer, and the overall size, thinking Brown Goshawk as well, but as always happy to be wrong! Probably won't make any difference with this bird, as their ranges are similar and found in most parts of our country, but often helps to give a location. Nice photo by the way.
It doesn't seem to have the intense frown of a Brown Goshawk but it does seem to have the bulkier build of that species - unless the appearance of a relatively bulky build is caused by a fluffing of the wings.
Collared Sparrowhawk or Brown Goshawk. It looks quite bulky to me and I would suggest Goshawk but they are hard to tell apart and I'm not sure which

thanks. Yes now I'm unsure between the two
taken in backyard near the bird sanctuary, Lake Colac, Victoria. This is from a different angle....

this photo gives a better indication of size perhaps?
i reckon it's a female sparrowhawk, based on lack of prominent brow ridge, square tail, long middle toe, and thin legs.
I agree with Zosterops.
